GAP Turbos Product Warranty

1.0 Warranty

1.1 GAP Turbos offers a warranty, to the original purchaser, for the repair or replacement of their turbocharger for a period of 24 months or 2 years from the date of purchase. Proof and date of original purchase of turbo and oil feed pipe will be required before any warranty can be considered. Units for which a claim is being made must be returned to GAP Turbos complete, any attempt to dismantle or repair the unit will invalidate the conditions of the warranty. Any product returned under warranty must be accompanied with a proof of purchase and warranty claim form (available from GAP Turbos on request).
1.2 The warranty does not cover cost of any labour or materials required to remove or re-install the turbo, or any other ancillary costs other than those directly attributable to the repair or replacement of the turbocharger itself. All other liabilities such as indirect or consequential loss (including loss of profit) are expressly excluded.
1.3 Warranty will be void if the product supplied is dismantled or tampered with in any way. All products must be returned, complete, as supplied: in the case of turbochargers this must include the wastegate actuator (pneumatic or electronic) for warranty inspection and analysis to be conducted.

2.0 Fitting

Any turbo purchased must be fitted correctly, following the fitting guide supplied at time of purchase.
2.1 Please follow all vehicle manufacturers instructions, as well as GAP Turbos, checklist.
2.2 Removing and re-fitting a turbocharger, is straightforward, but should not be attempted by anyone without the appropriate experience or expertise.
2.3 GAP Turbos recommends that their turbochargers are fitted by a qualified auto technician, someone possessing the knowledge to fit a turbo correctly.
2.4 Incorrect fitting, poor engine condition or maintenance, insufficient air or oil filtration could all lead to a warranty claim being rejected.

3.0 Returns

You have the right to cancel this contract within 7 days of receiving our product, in accordance with the Distance Selling Regulations 2000. 

Any turbocharger returned during the warranty period will be subject to a report on the condition, by GAP Turbos.
3.1 The results of this report is usually indicative, as to the reason, for any premature turbo charger failure.
3.2 An independent engineer’s report carried out by an established turbo reconditioner that is VAT registered.
3.3 If we have any disagreement about this warranty which we are unable to resolve we will abide by the decision of an agreed arbitrator or, if we are unable to agree the Law Society will appoint one.

4.0 Modifications

In any situation where manufacturers standard boost pressures or fuel setting have been changed or any device is used to modify them, the warranty will be void or invalidated. Proof may be required of proper maintenance of manufacturers routine service levels and intervals, with particular regard to oil and filter changes.
4.1 Failure to comply with manufacturers service requirements will invalidate this warranty.

5.0 Contract of Purchase

Where the buyer under the Contract (not being a Contract for the International Sale of Goods) deals as a Consumer within Section 12 of the Unfair Contract Terms Act 1977 then nothing contained in any of the following Conditions shall restrict or affect the statutory rights of the buyer.

6.0 Defects

GAP Turbos warranty that goods shall be free of defect in workmanship and components.
6.1 If any goods contain such defects, upon written notice thereof by the Buyer, GAP Turbos shall have the right in its discretion to repair or replace the defective goods or refund a pro-rata of the purchase price applicable to defective goods.
6.2 Save as provided herein, all representations, conditions, warranties and terms, whether express, or implied by common law statute or otherwise, as to the quality, condition or fitness for any purpose of the goods are excluded.

7.0 Warranty Duration

In the case of turbochargers, this warranty covers goods manufactured, re-manufactured and serviced by GAP Turbos for a period of 24 months (2 years), after delivery to the user/purchaser.
7.1 In the case of petrol engine turbochargers, GAP Turbos shall warrant for a period of 12 months, after delivery to the user/purchaser.
7.2 In the case of other components or parts manufactured, re-manufactured and serviced by GAP Turbos, the warranty period will be given upon request.

8.0 Other Warranty Conditions

8.1 The turbocharger must be fitted to an engine that is in good working order so that the operation of the turbocharger is not prejudiced.
8.2 The engine oil, oil filter and air filter must be changed at the point of turbocharger fitment, using only components and materials approved by the vehicle manufacturers. In the case of petrol engine turbochargers, GAP Turbos only recommend fully synthetic oil or that recommended by the vehicle manufacturer.
8.3 The purchasers/installers shall satisfy themselves that all reasonable steps have been taken to ensure that any original cause of turbocharger failure has been eliminated and that the turbocharger is correct for the application, and is fitted entirely in line with the engine manufacturer’s recommendations.
8.4 Warranty may be denied in the event of either the turbocharger or the engine being modified to increase power output, if this modification is prejudicial to the performance of the turbocharger.
8.5 Under no circumstances should a vehicle be used if a turbocharger problem is suspected as this could cause further damage to the turbocharger and/or engine.

9.0 Limitation and Exclusion of Liabilities

9.1 The Company’s obligations and liabilities to the buyer in respect of the goods shall be limited to: –
(i) Those set out expressly herein
(ii) Those implied (as to the title etc.) by Section 12 of the Sale of Goods Act 1994
(iii) Any liability for death, personal injury and loss of or damage to property under Section 2 of the Consumer Protection Act 1987
(iv) Where the contract is not an international supply contract within Section 26(3) of the Unfair Contract Terms Act 1977, any liability for death or personal injury resulting from negligence (as defined in that Act).
(v) In no event shall GAP Turbos be liable under this warranty for any amounts in excess of the purchase price of the goods and no allowance will be made for labour. GAP Turbos shall not be liable for contingent or consequential damages.
